1. PURPOSE OF THE AGREEMENT
ABOVE THE SEA EXPERIENCES agrees to provide THE MEMBER with a space on its website and to use part of the membership fees to carry out advertising campaigns that generate potential clients and traffic thru the market place. THE MEMBER agrees to pay the corresponding membership fee to enjoy these benefits.
2. DURATION AND TERM
2.1. This agreement shall have an initial duration of 30 days starting from the date of payment or signing.
2.2. Upon expiration of the term, the agreement will automatically renew for equal periods unless either party provides written notice of its intention not to renew at least 15 days in advance.
3. OBLIGATIONS OF THE PARTIES
3.1. Obligations of THE PLATFORM:
- Provide THE MEMBER with a space on the website to promote their services or products.
- Invest part of the revenue generated from memberships into advertising campaigns aimed at attracting potential clients.
- Provide periodic reports to THE MEMBER on the impact of the campaigns and the traffic generated.
3.2. Obligations of THE MEMBER:
- Pay the membership fee promptly according to the selected plan.
- Provide complete, accurate, and updated information about their products or services.
- Respond promptly to potential clients referred by ABOVE THE SEA EXPERIENCE.
4. FEES AND PAYMENT METHOD
4.1. THE MEMBER shall pay ABOVE THE SEA EXPERIENCE the amount of basis, corresponding to the selected plan.
4.2. Payment shall be made via ACH, Credit card, debit card, apple pay, google pay, paypal.
4.3. ABOVE THE SEA EXPERIENCES may suspend access to the services in case of non-payment.
5. ADVERTISING POLICY
5.1. ABOVE THE SEA EXPERIENCES reserves the right to determine the advertising strategies employed to maximize the impact of the campaigns.
5.2. THE MEMBER acknowledges that ABOVE THE SEA EXPERIENCES does not guarantee a specific number of potential clients or concrete financial results derived from the campaigns.
6. CANCELLATION REFUNDS AND TERMINATION
6.1. THE MEMBER may cancel their membership at any time by providing written notice at least 7 days in advance. No refunds will be issued for payments already made. No refunds will be issued for payments already made under any circumstances.
6.2. ABOVE THE SEA EXPERIENCES may terminate this agreement early if THE MEMBER breaches any of the obligations stipulated in this agreement.
7. CONFIDENTIALITY AND DATA PROTECTION
7.1. Both parties agree to maintain the confidentiality of the information shared during the term of this agreement.
7.2. ABOVE THE SEA EXPERIENCES shall comply with the applicable regulations on personal data protection and privacy.
8. MODIFICATIONS
8.1. ABOVE THE SEA EXPERIENCES Reserves the right to modify the terms and conditions of this agreement, notifying THE MEMBER at least 30 days in advance.
